How to Request Your Immigration Records (FOIA/PA)

Note: You have the right to request your immigration records from USCIS, CBP, or EOIR under the Freedom of Information Act (FOIA) or Privacy Act (PA).

What is a FOIA/PA Request?

FOIA (Freedom of Information Act) and PA (Privacy Act) allow you to request copies of your immigration records from U.S. government agencies. This can include applications, decisions, and correspondence.

How to Request Your Records

  1. Go to the USCIS FOIA Request page
  2. Choose the agency you need records from (USCIS, CBP, EOIR, ICE, etc.)
  3. Follow the instructions to submit an online request or download Form G-639 (for mail/fax requests)
  4. Provide as much identifying information as possible (A-number, full name, date of birth, etc.)
  5. Submit your request and keep your confirmation number

FAQs

  • How long does it take? FOIA requests can take several weeks to several months, depending on the agency and complexity.
  • Is there a fee? Most requests are free, but agencies may charge for large or complex requests. You will be notified if a fee applies.
  • What if I need my records urgently? You can request expedited processing, but you must show a compelling need (e.g., court deadline).
  • Can someone else request my records? Only with your written consent or legal authority (e.g., attorney with signed release).
