What is Form I-864?
The Affidavit of Support is required for most family-based and some employment-based immigrants. The sponsor promises to support the immigrant financially if needed.
Who Must File?
- U.S. citizens or lawful permanent residents petitioning for a family member
- Some employment-based immigrants if the employer is a relative

- Sponsor must be at least 18 years old and live in the U.S.
- Must meet minimum income requirements (usually 125% of the Federal Poverty Guidelines)
- May use a joint sponsor if needed

- What documents do I need? Proof of income (tax returns, W-2s), proof of status, and the completed I-864 form.
- How long does the obligation last? Until the immigrant becomes a U.S. citizen, works 40 quarters, leaves the U.S. permanently, or dies.
- Can I withdraw my support? No, once the immigrant gets a green card, the obligation is binding.
- What if I don't meet the income requirement? You can use a joint sponsor or household member's income.

- Submit with the immigrant's application (not directly to USCIS unless instructed)
