The
"Immediate Relative" is an immigrant petition which
allows some foreign nationals to apply for legal permanent residence
in the United States on the basis of their familial relationship
to a United States citizen. The primary befits of this type of
application is that (1) Immediate relatives receive preferential
treatment and are not subject to numerical quotas imposed on family
preference categories; and (2) If the relative entered with a
proper visa, he or she will be able to change status in the United
States even if they overstayed their visa or worked without permission.
Who is eligible? Spouse of a
U.S. citizen; parent or step-parent of a US citizen; child or
stepchild under the age of 21 of a U.S. citizen and spouse of
a deceased U.S. citizen. Note: A step-parent
or child will qualify for immigration only if the marriage creating
the step parent/child relationship occurs before the child's eighteenth
birthday.
